Customers requesting delivery services agree to comply with the policies outlined below. 1. Curbside / Driveway Delivery Only All deliveries are curbside or driveway delivery only. Curbside delivery means the driver will unload items at the closest safe and accessible location to the delivery vehicle, typically the curb or driveway. Drivers are not responsible for moving materials beyond this location, including inside homes, garages, job sites, or up driveways, stairs, or pathways. Customers are responsible for arranging adequate labor to move materials from the curbside delivery location. 2. Delivery Address Confirmation Customers must provide a complete and accurate delivery address at the time of order placement. All delivery addresses are subject to approval based on serviceability. NGY Group Inc. will not contact homeowners directly to coordinate residential deliveries; coordination with the end customer is the responsibility of the purchasing customer. Incorrect or incomplete address information may result in additional delivery charges. 3. Customer Presence Requirement The customer or their authorized representative must be present at the delivery location during the scheduled delivery window to receive, inspect, and sign for the delivery. Drivers will wait a maximum of 20 minutes from the time of arrival. If no representative is present within this timeframe, the delivery will be considered a failed delivery, the order may be returned to the warehouse, and a re-delivery fee will apply. Re-delivery fees must be paid in full prior to rescheduling delivery. 4. Delivery Window A delivery window will be provided in advance. While every effort will be made to deliver within the scheduled window, delays may occur due to circumstances beyond our control including traffic conditions, weather, mechanical issues, or delays from prior deliveries. NGY Group Inc. will make reasonable efforts to notify customers of delays when possible. 5. Failed Delivery / Re-Delivery Fees A delivery will be considered failed if it cannot be completed due to customer absence, incorrect address information, inaccessible delivery location, or unsafe unloading conditions. In such cases, a re-delivery fee equal to the original delivery fee or a minimum of $150 (whichever is greater) will apply. NGY Group Inc. reserves the right to adjust re-delivery fees based on distance, logistics, and handling requirements. 6. Delivery Access Requirements The customer is responsible for ensuring that the delivery location is accessible to a standard box truck or freight vehicle and that the unloading area is safe and clear of obstacles. NGY Group Inc. is not responsible for deliveries that cannot be completed due to narrow streets, restricted access roads, low clearance areas, construction site limitations, or lack of adequate unloading space. If the driver determines the location is unsafe or inaccessible, delivery may be refused and a re-delivery fee will apply. 7. Inspection Upon Delivery All items must be visually inspected at the time of delivery. Customers must inspect all cartons, pallets, and packaging for visible damage or discrepancies before signing the delivery receipt. Any visible damage, shortages, or discrepancies must be clearly noted on the delivery receipt prior to signing. 8. Delivery Acceptance & Liability By signing the delivery receipt, the customer confirms that the shipment has been received, the order appears complete, and no visible damage was observed unless otherwise noted. Once the delivery receipt is signed, NGY Group Inc. assumes no responsibility for damage, loss, or missing items not documented at the time of delivery. To the fullest extent permitted by law, NGY Group Inc. shall not be liable for damage occurring after delivery acceptance. 9. Concealed Damage Reporting If concealed damage is discovered after unpacking, it must be reported within 24 hours of delivery. Claims submitted after this timeframe may be denied. All claims must include photographs of the damaged product, photographs of the original packaging, and the order number and SKU information. NGY Group Inc. reserves the right to deny claims that do not meet these requirements. Installation, modification, or assembly of any product constitutes acceptance of the item and waives any damage or defect claims. 10. Order Verification & Missing Items Customers are responsible for verifying the quantity of cartons and items received at the time of delivery. Any missing items must be noted on the delivery receipt at the time of delivery. Claims for missing items will not be accepted once the delivery receipt has been signed without notation of shortage. 11. Delivery Documentation NGY Group Inc. may document deliveries using photographs and digital records at the time of delivery, including the condition of packaging, delivery location, delivered materials, and signed delivery confirmation. These records may be used to verify delivery condition, quantity delivered, and resolve disputes. 12. Non-Refundable Delivery Fee Delivery fees are non-refundable once delivery has been scheduled. Delivery fees cover transportation, labor, and logistics costs associated with the delivery service. 13. Returns & Exchanges NGY Group Inc. does not facilitate pickup or return of materials once delivered. Customers are responsible for arranging transportation for any returns or exchanges in accordance with the company’s return policy. 14. Force Majeure NGY Group Inc. shall not be liable for delays or failure to perform its delivery obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather conditions, labor disputes, governmental actions, transportation disruptions, or other events that make delivery impractical or impossible. 15. Acknowledgment & Acceptance of Delivery Terms By signing below, the customer confirms that they have read, understood, and agree to the NGY Group Inc. Delivery Program Terms & Conditions outlined above. These terms apply to all delivery services unless otherwise agreed to in writing.
